1. Account Registration & Use

  • To register, you must provide your full name, address, phone number, a valid email, and a secure password. Incomplete or inaccurate details may prevent us from activating your account or fulfilling orders.

  • Only one account is allowed per email address.

  • Do not use another person’s account without permission.

  • After registering, you will receive a confirmation email. If you opt-in to our newsletter, you’ll receive updates on promotions and deliveries.

  • You are responsible for keeping your password secure and must notify us immediately of any unauthorised use or security breaches.

  • We may suspend or terminate your account at our discretion, particularly if you breach these terms.

  • Please ensure your account details remain up to date via the website or by contacting Customer Service.

2. Legal Capacity

By placing an order, you confirm that:

  • You accept these terms;

  • You’re legally capable of entering into a contract with us;

  • Your order and these terms form a binding agreement with ailiving.com.au.

Note: If a minor places an order, their parent or guardian may be held responsible for any resulting losses.

3. Placing Orders

  • All orders are subject to acceptance by ailiving.com.au.

  • Product images and descriptions are for illustration only; actual items may vary.

  • Submitting an order is considered an offer to purchase and does not guarantee acceptance.

  • A contract is formed once we confirm the order and receive full payment.

  • Once submitted, orders cannot be cancelled unless stated otherwise in these terms.

  • You’ll receive an email confirmation upon successful order placement and payment.

  • If your order is not accepted, we’ll notify you and issue a refund within 3–5 business days.

  • We reserve the right to accept or reject any order for any reason.

4. Pricing

  • All prices are in Australian dollars (AUD) and include GST, unless stated otherwise.

  • Delivery and insurance fees may be additional.

  • Prices are subject to change without notice and are confirmed at the time of order dispatch.

  • Promotional pricing and savings are based on the manufacturer’s RRP or our standard pricing.

  • Accessories shown in product images are not included unless specified.

  • We reserve the right to correct pricing errors at any time.

5. Payment

  • Full payment is required before products are shipped or collected.

  • Accepted payment methods include Direct Deposit, Credit Card, PayPal, and EWAY.

  • All transactions are processed via secure payment gateways.

  • Additional fees may apply for overdue accounts, including legal recovery costs.

6. Delivery & Supply

  • Delivery is arranged once full payment is received.

  • While we strive for prompt delivery, we’re not liable for courier delays.

  • We deliver to the address provided at checkout. You are responsible for ensuring address accuracy.

  • We recommend purchasing shipping insurance for protection against loss or damage.

  • Orders may be delivered in separate shipments.

  • Furniture orders may take up to 10 weeks due to manufacturing lead times.

  • For remote areas, delivery may exceed 10 business days.

7. Shipping Information

  • Delivery must be to a physical Australian address — not PO boxes or forwarding services.

  • You will be contacted if your order includes large or bulky items to arrange delivery.

  • Ensure someone is available to accept delivery.

  • Notify us at least 48 hours before dispatch for any changes to address or delivery date.

  • Let us know of any delivery difficulties (e.g. stairs or tight access) in advance. Extra charges may apply if not disclosed.

  • We are not liable for courier-related delays or missed deliveries.

8. Click & Collect

  • If you choose to collect from a showroom, we’ll notify you when your order is ready.

  • Orders must be collected within 15 days of notification. After this, the items may be reallocated.

9. Fraud Prevention

Due to increased fraud risk:

  • For some credit card orders, we may charge a small random amount (under $2.00) for verification, refunded immediately after confirmation.

  • You must confirm this amount via phone or email before we dispatch your order.

  • Only Australian-issued credit cards are accepted.

10. Disclaimer & Indemnity

To the extent permitted by law:

  • ailiving.com.au is not liable for any damages (direct or indirect) resulting from:

    • Errors or inaccuracies on the site.

    • Unauthorised access to user data.

    • Site outages or disruptions.

    • Third-party links or harmful software.

  • You agree to indemnify ailiving.com.au and its affiliates from any claim or loss arising from your use of the site or breach of these terms.

11. Force Majeure

We are not responsible for delays caused by events outside our control, including natural disasters, strikes, supply issues, or internet outages.

12. Governing Law

These terms are governed by the laws of New South Wales, Australia. By using our website, you agree to comply with applicable local laws.

13. Severability

If any part of these terms is deemed unenforceable, the remainder will still apply.

14. Assignment

If ailiving.com.au undergoes a business change (e.g., sale or merger), we may transfer your data and agreement to the new entity without notice.

15. Waiver

Our failure to enforce any right or term doesn’t waive our ability to do so in the future.
